Instrument Marketplace

Terms & Conditions

Placeholder version. This text is a non-binding template and does not replace legal review before going live.

1. Scope

These Terms & Conditions ("Terms") govern the use of the Instrument Marketplace platform (the "Platform") by musicians, collectors, students, and instrument dealers (together, "Users").

2. Description of Service

The Platform is a discovery and introduction service for string instruments. It lets dealers list instruments and lets musicians find them and contact the respective dealer. The actual purchase, payment, and handover of an instrument happen directly between buyer and dealer, outside the Platform. The Platform itself is not a party to the sales contract for any instrument.

3. Registration and Account

Certain features (favorites, collections, messaging, dealer profile) require registration via magic link or a Google, Apple, LinkedIn, or Facebook account. Users must provide accurate information and must not share their account with third parties.

4. Dealer Obligations

Dealers are solely responsible for the accuracy of their listings (description, condition, provenance, price). Misleading or unlawful listings may be removed without prior notice (see reporting/moderation).

5. Premium Memberships and Payments

Dealers may purchase paid premium placements (featured listings for a fixed period). Payment is processed via the payment provider Stripe, whose own terms additionally apply. Premium payments are, to the extent permitted by law, non-refundable.

6. Rules of Use

Prohibited conduct includes, without limitation: listing stolen or unlawfully acquired instruments, harassing other users, automated scraping of the Platform, and attempting to circumvent security mechanisms.

7. Limitation of Liability

The Platform makes no warranty as to the authenticity, condition, or value of any instrument presented on it. The Platform is not a party to, and is not liable for, disputes between buyer and dealer arising from the sales contract, to the extent permitted by law.

8. Termination and Suspension

Users may request account termination via support at any time. The Platform reserves the right to suspend accounts that violate these Terms.

9. Changes to these Terms

These Terms may be updated from time to time, for example when new features are added. Material changes will be announced on the Platform.

10. Governing Law

The laws of the operator's place of business apply (placeholder — to be completed before going live).

11. Contact

Questions about these Terms can be sent to support@example.com or via the contact form.
